Luciano Butti and Andrea Rizzo share some insights on a recent decision adopted by the Liguria Regional Administrative Tribunal (n. 1346 of 5 September 2014), which clarifies that the “polluter-pays-principle” cannot be invoked as the legal basis to impose site safety measures upon the responsible party.
