The cost of compliance with environmental regulation can be very high and is a crucial issue. The aim of this article is to evaluate if and to what extent, according to national and international courts, governments and agencies should take into account the costs which may be incurred by their decisions and orders when deciding on measures of environmental protection. Case law from UK, Italy, U.S.A., The Netherlands and the European Court of Justice will be analyzed.
